Lexis Defender

By accessing or using Lexis Defender ("Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not access or use the Service.

1. Eligibility and Account Use

You must be at least 18 years old and have the legal capacity to enter into a binding agreement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

We may suspend or terminate access at our discretion for violations, suspected misuse, or conduct that poses legal, security, or operational risk.

2. Nature of the Service – No Legal Advice

Lexis Defender provides general legal information, educational guidance, and document-assistance tools generated through automated systems.

  • Lexis Defender is not a law firm.
  • We do not provide legal advice, legal opinions, or legal representation.
  • Use of the Service does not create an attorney-client relationship.

Any information provided may be incomplete, inaccurate, outdated, or inapplicable to your specific situation. You are solely responsible for verifying all information and determining its suitability. Consult a licensed attorney for advice regarding your specific legal matter.

3. Acceptable Use Restrictions (Critical)

You agree that you will not, directly or indirectly:

  • Reverse engineer, decompile, disassemble, or attempt to derive source code, prompt logic, workflows, or internal processes.
  • Scrape, harvest, extract, copy, or reproduce content or outputs to train, develop, or enhance competing products or services.
  • Use the Service to build, benchmark, or validate any competing legal, AI, automation, or document-generation system.
  • Share, resell, sublicense, or distribute outputs in a manner that competes with or substitutes for Lexis Defender.
  • Circumvent usage limits, access controls, tier restrictions, or payment systems.
  • Use automated tools, bots, or scripts to access or interact with the Service without express written permission.

Any such activity constitutes a material breach of these Terms.

4. Intellectual Property Rights

4.1 Platform IP

All aspects of the Service, including system architecture, prompt structures, legal modules, tier-gated logic, and UI layouts, are proprietary to Lexis Defender and protected under applicable laws. No rights are granted except as expressly stated.

4.2 User Content

You retain ownership of content you submit. By submitting content, you grant Lexis Defender a non-exclusive, worldwide, royalty-free license to use, process, store, and analyze such content solely to operate and improve the Service. We do not sell your private user content.

5. Trade Secrets and Confidential Systems

You acknowledge that Lexis Defender contains confidential and proprietary systems, including non-public logic, methods, and processes that constitute trade secrets. Unauthorized disclosure, replication, or misuse may result in immediate termination and legal action, including injunctive relief.

6. Output Limitations and User Responsibility

All outputs are generated automatically and are not guaranteed to be accurate, complete, or compliant with jurisdiction-specific requirements.

You assume full responsibility for reviewing outputs, verifying legal citations, ensuring compliance with court rules, and any decisions or actions taken based on the Service. Lexis Defender disclaims responsibility for outcomes resulting from reliance on generated content.

7. Limitation of Liability

To the maximum extent permitted by law, Lexis Defender is not liable for indirect, incidental, consequential, special, or punitive damages, including loss of rights, claims dismissed, procedural errors, lost opportunities, or financial losses.

Our total liability for any claim shall not exceed the amount paid by you to Lexis Defender in the preceding 30 days, or $100, whichever is greater.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE." We make no warranties, express or implied, including but not limited to accuracy, completeness, fitness for a particular purpose, legal compliance, or uninterrupted availability. Use of the Service is at your own risk.

9. Termination

We may suspend or terminate access to the Service at any time, with or without notice, for violations of these Terms or conduct that threatens the integrity of the Platform. Sections covering intellectual property, trade secrets, disclaimers, limitations of liability, and governing law survive termination.

10. Plans, Usage Allowances, and Active Cases

Paid plans include stated monthly allowances for AI actions, document saves, uploaded pages or images analyzed, AI processing, and active case slots. Current allowances are displayed on the Pricing page and your Dashboard.

  • Allowances reset at the beginning of each billing period and do not roll over unless expressly stated.
  • AI processing is measured using provider-reported input, output, cached, and reasoning-token usage. Images and documents may consume more processing than short text.
  • We may reserve estimated processing capacity before a request and reconcile it against actual usage after completion.
  • Archived cases remain accessible but do not occupy an active-case slot. Restoring a case requires an available slot.
  • When an allowance is exhausted, processing may pause until renewal, an add-on purchase, archival of an active case, or a plan upgrade.

We may adjust future plan allowances with notice. Changes do not retroactively remove outputs already created.

11. Subscriptions, Renewal, and Cancellation

Subscriptions renew automatically at the selected billing interval until cancelled. You may cancel before the next renewal through the billing portal. Cancellation stops future renewals but does not ordinarily create a prorated refund for the current period. Taxes may apply. Refund eligibility is governed by the Refund Policy.

12. Uploaded Content and Automated Analysis

You represent that you have the right to upload and process submitted files. Do not upload material unrelated to the requested service or information you are not authorized to disclose.

OCR, image recognition, document extraction, summaries, dates, deadlines, and other automated results may be incomplete or incorrect. Extracted facts remain unconfirmed until you review them. You are responsible for checking the original document and all deadlines before acting or filing.

Requested content is processed by service providers, including OpenAI, only as needed to deliver the requested feature, subject to the Privacy Policy.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles.

Any disputes must be brought exclusively in the state or federal courts located in Kansas, and you consent to personal jurisdiction there.

14. Modifications

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
